Terms of Service
These Terms of Service ("Terms") govern your access to and use of NimbleSafe (a myosh product) and its related services. By accessing or using NimbleSafe, you agree to be bound by these Terms.
1. Acceptance of Terms
By registering for an account, accessing the NimbleSafe platform, or using our services, you agree to these Terms. If you are accepting these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Subscription and Payment
NimbleSafe is a subscription-based service. Subscription fees are billed in advance on a recurring basis as per your chosen plan.
Suspension for Non-Payment
NimbleSafe reserves the right to suspend system access if subscription fees remain unpaid beyond the agreed payment terms. If an account is suspended due to non-payment, a re-establishment fee may apply to reinstate access. Service will only be restored once all outstanding amounts and applicable fees have been paid in full.
3. Data Imports
NimbleSafe allows you to import your existing safety data into the platform.
Self-Service Imports
Users are able to extract our prepared spreadsheet templates and import their own records directly into the system. If you choose this route, you assume full responsibility for verifying the integrity and accuracy of the data after the import process is complete.
Assisted Imports
As a convenience service, NimbleSafe staff can assist with importing your data. If you choose this option:
- Data must be provided on NimbleSafe's prepared spreadsheet templates.
- We assume that the data provided is clean and ready for import.
- If NimbleSafe staff are required to expend effort rectifying data errors or cleaning the provided data, this work will be charged on a time and materials basis.
- Assisted imports will be charged at a flat rate of AUD $199.00 per spreadsheet.
4. Platform Use and Responsibilities
- Lawful Use: You agree to use NimbleSafe only for lawful purposes and in accordance with these Terms.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Data Ownership: You retain all rights to the data you enter into NimbleSafe. We claim no ownership over your data.
- Service Availability: While we strive for high availability, NimbleSafe is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access to the service.
5. Limitation of Liability
To the maximum extent permitted by law, NimbleSafe (and its parent company, myosh) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the service.
6. Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you via email or through the service. Your continued use of NimbleSafe after any such changes constitutes your acceptance of the new Terms.
